Attorney David Domina filed a new court appeal on Friday, June 2 with the Nebraska Supreme Court on behalf of several residents from the Whiteclay area who support the closure of the beer stores.
The appeal claims that Lancaster County District Judge Andrew Jacobsen, who overturned the decision of the Nebraska Liquor Control Commission to close the beer stores, lacked the jurisdiction to do so. Domina has asked the state Supreme Court to nullify that action and allow the original decision by the liquor board to stand.
Domina stated that four of his clients, who are residents of Sheridan County, were not allowed to make their arguments in front of the judge back in April. According to Domina, this is a jurisdictional defect voiding any actions taken by the judge.
The Supreme Court will hear this new appeal, along with other legal arguments, during the oral arguments currently scheduled for August 29.
