After more than five years of debate and courtroom appearances over where or where not to build the Keystone XL Pipeline, President Barack Obama’s announced that he would reject TransCanada’s attempt to secure an international border crossing permit, at least until our lawsuits challenging the constitutionality of the company’s eminent domain rights were decided. Our involvement in the case began when a Nebraska rancher questioned whether or not a foreign for-profit oil company had the right to seize their land to increase profits from a product that would never make its way to the U.S. While the President’s decision was a major step forward in the case, our fight to challenge the constitutionality of eminent domain law goes on, and we will not stop until these unconstitutional laws are removed.
This eminent domain law continues to affect ranchers in Nebraska. In a lawsuit filed by Dan and Barbara Welch, ranchers whose land lies in the Nebraska Sandhills, they are challenging the constitutionality of Nebraska Revised Statute § 76-702, which the Nebraska Public Power District (NPPD) cites as their justification for entering and surveying private land in order to prepare for a project estimated to cost $361 million. Like the families affected by the threat of eminent domain rights in the Keystone XL Pipeline case, these ranchers are fighting for the right to remain on their land.
Our support of ranchers and farmers goes beyond protecting their land from seizure. In a 2015 investigation by the World Health Organization (WHO), they reported that “Roundup is probably carcinogenic to humans.” We currently represent four Nebraska farmers – Larry Domina, Frank Pollard, Robert Dickey, and Royce Janzen – who report that their non-Hodgkin’s lymphoma was caused by Monsanto’s product. In their lawsuit, they claim that the product that generated $4.8 billion in sales for Monsanto in 2015 was mislabeled and fails to warn uses of its negative side effects.
