David A. Domina, a Nebraska trial lawyer whose firm studied the Keystone proposal, says it is hard to imagine local judges and juries in eminent domain cases—both in initial stages and on appeal—siding with a Canadian company against their neighbors. Eventually, the judges will have to face a public vote, he says: “In a project this controversial, all it takes is one judge who says, ‘I don’t like this process,’ and then you may have to start over.”
