Boston Zofran MDL at 200 Lawsuits and Growing

When multiple plaintiffs (hundreds, sometimes thousands) in different districts share common issues and their civil actions involve one or more common questions of fact, these cases can be consolidated into what is called “multidistrict litigation” or “MDL.” Currently, more than 200 Zofran cases have been consolidated into an MDL in Boston.

This MDL contains multiple plaintiffs who are all making similar allegations – that taking Zofran while pregnant caused their child to be born with birth defects, that GlaxoSmithKline (the maker of Zofran) knew about the potential risks, and that the drug manufacturer failed to warn doctors and consumers of that risk.

You can read more detailed information about Zofran here, but essentially, Zofran (ondansetron) is an anti-nausea drug originally approved by the U.S. Food and Drug Administration (FDA) to treat cancer patients suffering from nausea after treatments such as chemotherapy. The drug was then (many claim wrongfully) marketed to pregnant women to treat morning sickness.
