Constitutional Issues
Domina Law Group is believed to be the only law firm in the United States to have had a lead role in two impeachments of constitutional officers. In Nebraska, three impeachments have occurred in state history, the first was over 130 years ago.
The two in which David A. Domina played the roles of chief investigator, and trial lawyer respectively are:
- Nebraska Legislature ex rel State v. Hergert - 271 Neb. 976, 720 N.W.2d 372 (2006)

State v. Douglas - 217 Neb. 199, 349 N.W.2d 870 (1984)
Domina Law Group achieved declaration that the Nebraska property taxation system was unconstitutional. The system was scrapped and the Legislature “started over” as a result:
- Jaksha v. State- 241 Neb. 106, 486 N.W.2d 858 (1992)
Domina Law Group also spearheaded litigation against TransCanada over the constitutionality of their Keystone XL Pipeline. View more information on this litigation.
In 2012, we handled a case regarding the constitutional privilege against self-incrimination under the Fifth Amendment:
